Today’s case would clearly be illicit if we were to apply Spanish laws regarding advertising. To advertise a hamburger a woman’s body as she sunbathes is used in a completely decoupled from the actual product. Even though at the end of the televisión ad there is a hint of humor, the advert as a whole is not perceived as a humoristic exaggeration, therefore we are looking at a clear case of distorted competition.

This is an example of discriminatory advertising because the product is disassociate with the woman body and the woman is treated like a sexual object.

What we can say about this ad? Well, even on the one hand advertisers can justifie that it’s an ad that contains an eminent humoristic content, if we apply the law regarding the spanish advertising control, this ad could be a clear example of discriminatory ad. It isn’t right because we use the woman stereotype with is body so detached from the product.
