In this TV spot, broadcast in the United States compared to each one of the brands of cars representing them with the keys that takes the logo. It is attributed to each one of them a feature. Finely in the spot, the Audi brand compares implicitly as being the best of all, because it contains all the essential caracteristics of competitors.
In United States this permitted comparative advertising of this type, so we do the question…Would be legal in Spain? The answer is no. We would be faced with a case of illicit comparative advertising, because even if all products meet the basic need of driving, not be this by comparing any essential characteristic. But that is subjective is imposed that Audi is the best of all.

The present case is a commercial advertising of the brand Audi, in which it alludes directly to specifics brands of competitors. In my opinion, it is an act of unfair comparative advertising because Audi doesn’t compare pertinent, verifiable and representative characteristics objectively about the brands.

This brands are compared in such a way that it is considered ilegal. There is no information about relevant characteristics about the products, which is essential to compare brands in a legal way

Se trata de un caso de competencia ilícita en la que audi no compara productos homogéneos sino marcas diferentes con automóviles de distintas gamas. Por eso y por no comparar cualidades objetivas del producto, sería desleal e ilegal en España
